Your Information, including, but not limited to any space(s) listed on our Site must not: be false, inaccurate or misleading; be fraudulent or involve the listing of car space(s) without proper authority to do so; violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing consumer protection, unfair competition, criminal law, antidiscrimination or trade practices/fair trading laws); be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; concurrently be listed for lease on a website other than TurkeyParking.com, or similar media, (this does not prevent linking to or advertising a Turnkey Parking item from another web site);
Without limiting any other remedies available to Turnkey Parking at law, in equity or under this Agreement, by use of this site, Turnkey Parking may, in its sole discretion, suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise in our sole discretion) have engaged in fraudulent activity in connection with our Terms & Conditions of this website and refuse to provide our services to you if: you breach this Agreement, the Privacy Policy or any other agreement between you and Turnkey Parking; we are unable to verify or authenticate any information you provide to us; or we believe that your actions may cause legal liability for you, our users or us.

You agree to indemnify and hold Turnkey Parking and its subsidiaries, affiliates, officers, directors, agents, and employees, harmless from and against any claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable solicitors' fees, made by any third party due to or arising out of your breach of this Agreement or the terms and policies it incorporates by reference, or your violation of any law or the rights of a third party.
Notwithstanding the above provisions, nothing in this Agreement is intended to limit or exclude any liability on the part of Turnkey Parking and its affiliates and related entities where and to the extent that applicable law prohibits such exclusion or limitation.
You shall comply with all applicable domestic (including common law) and international laws, statutes, ordinances and regulations regarding your use of our services and your listing, renting, buying, solicitation of offers to purchase, and sale of items.YOU ALONE, AND NOT TURNKEY PARKING, ARE RESPONSIBLE FOR CONFIRMING THAT YOUR ACTIVITIES ARE LAWFUL. YOU MUST ENSURE THAT YOU COMPLY WITH ALL APPLICABLE LAWS. YOU MUST ALSO ENSURE THAT YOU COMPLY WITH ALL CLAUSES OF THIS AGREEMENT AND THE PRIVACY POLICY, AND ALL OTHER TERMS AND POLICIES INCORPORATED BY REFERENCE IN THOSE DOCUMENTS.
Any controversy or claim arising out of or in connection with this Agreement may, at our discretion, be settled by binding arbitration. You agree to be bound by the ruling arbitrator. All costs of the said dispute are to be borne by the originator of the dispute.
GOVERNING LAW This Agreement and its performance shall be governed by the laws of the state of Colorado, United States of America, without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado, United States of America, in all questions and controversies arising out of your use of the this website and this Agreement. To the extent allowed by applicable law, any claim or cause of action arising from or relating to your access or use of the Website must be brought within two (2) years from the date on which such claim or action arose or accrued.
SEVERABILITY The provisions of these Terms & Conditions are intended to be severable. If for any reason any provision of this Agreement shall be held invalid or unenforceable in whole or in part in any jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction. Use of this website and or any services contained herein constitutes ACKNOWLEDGEMENT of this Agreement, including all documents referenced herein, represents the entire understanding between you and Turnkey Parking regarding your relationship with Turnkey Parking and supersedes any prior statements or representations. Attorney’s Fees If Turnkey Parking or its affiliates take any action to enforce this Agreement, or any agreement in connection with our site or services, such parties will be entitled to recover from you, and you agree to pay, all reasonable and necessary attorney's fees and any cost of litigation, in addition to any other relief, at law or in equity, to which such parties may be entitled.
If, notwithstanding the foregoing, Turnkey Parking and any of its affiliates or third party providers should be found liable for any loss or damage which arises out of in connection with our site or services, the liability of such party(ies) shall in no event exceed, in the aggregate, US$100.00. In its sole discretion, in addition to any other rights or remedies available to us and without any liability whatsoever, we, at any time and without notice, may terminate or restrict your access to all of or any component of the Website. Some states do not allow limitation of liability, so the foregoing limitation may not apply to you.
